Business Restructuring and Down-Sizing In this practice area, particular emphasis is given to business restructuring and down-sizing, through the implementation of collective dismissal procedures, transfers of going concerns and related "acquired rights" procedures.
In relation to redundancies, collective dismissals and transfers of going concerns, the Firm has acquired a significant expertise in negotiating with trade unions and work councils, implementing the pertinent plant agreements and the ensuing collective and individual settlement agreements before the competent national agencies and bodies.
We also advise and assist our clients in all employment issues related to mergers, acquisitions and spin-offs.
Individual Employment Relationships Our lawyers provide regular and continuing assistance with respect to individual employment agreements, including part-time, fixed term and seasonal employment agreements, mandatory recruitment, fringe benefits, incentive and stock-option plans, mandatory and voluntary pension plans and schemes, employment-related intellectual property issues, individual dismissals, relocation of employees and health and safety at work.
Due to our significant foreign clientele, the Firm has acquired a particularly sound expertise in the handling of multi-jurisdictional issues concerning directors, executives and employees, as well as in the structuring and implementation of secondment, expatriate and other similar inter-company arrangements and agreements.
Outsorcing and Labour-Force Intermediation The Firm's labour and employment practice covers also the drafting and negotiation of agency and consultancy agreements, including the appointment and replacement of directors, as well as outsourcing contracts, with particular emphasis on the stringent rules of Italian law on the prohibition of "labour-force intermediation".
